Terms & Conditions

Welcome to Toofun Trips!

We’re here to create meaningful, fun, and memorable outdoor experiences. These Terms & Conditions are designed to ensure everything runs smoothly and safely for everyone.

By booking or participating in any of our experiences, you agree to the following:

 

  1. About Our Services

Toofun Trips provides:

  • Guided nature-based experiences
  • Outdoor recreational activities
  • Wellness and connection-focused group experiences
  • Group transportation

Our activities take place in outdoor environments across Victoria and Australia.

 

  1. Bookings & Payments

  • A booking is confirmed once full payment is received.
  • All prices are in Australian Dollars (AUD) and include GST where applicable.
  • We reserve the right to cancel any booking where payment has not been completed.

 

  1. Cancellations

  • All cancellation requests must be submitted via our website or by email to toofuntrips.connect@gmail.com.

 

     Refund Structure

  • 14 days or more before the experience: 100% refund
  • 7 to 14 days before: 50% refund
  • Less than 7 days before: No refund

No refunds will be provided for:

  • No-shows
  • Late arrivals
  • Leaving the experience early
  • Failure to meet participation requirements

We are unable to make exceptions, as costs and arrangements are incurred in advance.

Refunds will be processed to the original payment method in 14 days.

This cancellation policy is subject to your rights under the Australian Consumer Law.

 

  1. Late Arrival Policy

Participants must arrive at the designated meeting location at least 10–15 minutes prior to the scheduled departure time, unless otherwise advised.

All tours and experiences will depart at the scheduled start time. We are unable to delay departure for late participants.

If you arrive late or fail to arrive at the meeting point, you will be considered a no-show:

  • No refund will be provided
  • We are not responsible for arranging alternative transport or access to the experience

If you believe you may be late, you must contact us immediately. While we will do our best to assist, we cannot guarantee accommodation of late arrivals.

 

  1. Minimum Participant Numbers

Some experiences require a minimum number of participants to operate safely and viably.

If the minimum number is not reached, we reserve the right to:

  • Reschedule the experience to another date; or
  • Offer you a credit toward a future experience; or
  • Provide a full refund of the amount paid

We will notify you as soon as reasonably possible if an experience cannot proceed due to insufficient numbers.

We are not responsible for additional expenses you may incur, including travel or accommodation costs.

This policy is subject to your rights under the Australian Consumer Law.

 

  1. Participation & Assumption of Risk

Our experiences involve outdoor and recreational activities that carry inherent risks, including but not limited to:

  • Uneven terrain
  • Slips, trips and falls
  • Wildlife encounters
  • Changing weather conditions
  • Physical exertion
  • Remote locations

By participating, you:

  • Accept these risks
  • Confirm you are physically and medically fit
  • Agree to follow all guide instructions

Participation is at your own risk.

 

  1. Recreational Services Liability

Toofun Trips takes all reasonable care to provide safe and enjoyable tours. However, by joining our activities, you understand that there are inherent risks involved, including the risk of injury. To the maximum extent permitted by law, Toofun Trips is not responsible for any loss, damage, or injury that may occur during our tours.

To the extent permitted by law, you release Toofun Trips from any claims arising from participation in our experiences.

Nothing in these Terms excludes, restricts, or modifies rights you may have under Australian Consumer Law.

Where permitted by law, our liability is limited to:

  • Re-supplying the services; or
  • Paying the cost of having the services supplied again.

 

  1. Health & Medical Conditions

You must inform us of any relevant medical conditions at the time of booking.

We may refuse participation if safety concerns arise for you or others.

 

  1. Code of Conduct

Participants must:

  • Follow guide instructions
  • Behave respectfully toward others
  • Avoid unsafe or illegal behaviour

We reserve the right to remove any participant from an experience without refund if their behaviour poses a safety risk.

 

  1. Transportation

Where transport is provided:

  • Seatbelts must be worn at all times
  • Instructions must be followed
  • We are not responsible for personal belongings left in vehicles

 

  1. Personal Property

Toofun Trips is not responsible for loss, theft, or damage to personal belongings during experiences.

 

  1. Weather & Force Majeure

Experiences will generally run in most weather conditions unless deemed unsafe.

We may cancel, delay, or modify experiences due to events beyond our control, including:

  • Severe weather
  • Bushfires
  • Natural disasters
  • Government restrictions
  • Transport disruptions

No refunds will be provided for changes due to weather unless the experience is cancelled by us.

In such cases, we may offer rescheduling, credit, or refund where appropriate.

 

  1. Photography & Media

During our experiences, photos and videos may be taken and used for marketing purposes, including on social media, our website, and promotional materials.

By participating, you consent to this use unless you notify us otherwise in writing prior to the experience.

 

  1. Privacy

We collect personal information for booking, safety, and operational purposes. Your information is handled in accordance with Australian privacy laws.

  1. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any disputes will be subject to the jurisdiction of the courts of Victoria.
